The Ombudsperson held a round table discussion with the theme “Gender equality and the right on registration of joint immovable property on behalf of both spouses”

Ombudsperson Institution (OI) on 7 December 2017, held a round table with the topic “Gender equality and the right on registration of joint immovable property on behalf of both spouses”

Three basic Laws on Human Rights, Law no. 05/L-019 on Ombudsperson, Law no. 05/L-021 on Protection from Discrimination and the Law no. 05/L-020 on Gender Equality, adopted by the Assembly of Republic of Kosovo, which have entered into force on 13 July 2015, determine the Ombudsperson as a mechanism of handling the cases dealing with discrimination and among others handling of cases based on gender equality.

As per enforcement of the Law on Gender Equality and the Administrative Instruction No. 04/2017 on special measures for registration of joint immovable property on behalf of both spouses, the Ombudsperson considers of a great importance organizing of this kind of round table discussion in order to offer the possibility of joint discussion and deliberation regarding this theme between the Ombudsperson Institution, Public Institutions of central and local level as well as NGOs which directly deal with the issue of Gender Equality, with the intention of achieving gender equality in terms of property rights. He stressed that affirmative measures are standards which are applied by the lawmakers on specific cases until the aim is achieved, which in this case has not been applied.

Participants were agreed that in order to put in function institutional mechanisms on joint property and gender equality, citizens ought to be more informed about their rights. Further, they stressed the fact that this issue is treated by laws, but sublegal acts promulgated afterward ought to be more applicable in practice.

In the course of this round table OI representatives disclosed findings from the assessment conducted in the municipalities of Prishtina, Ferizaj and Gracanica and pointed out that 302 requests have been submitted in these three municipalities, actually 66 in Prishtina municipality, 201 in Ferizaj municipality and in Gracanica 35 requests.

Despite the fact that women continue to comprise most vulnerable group in terms of their rights, the Ombudsperson emphasized that as per implementation of laws which deal with the rights of women in joint property, awareness should rise not only among citizens but also among institutions’ officials of our society. The Ombudsperson also exposed his decisiveness for resolving gender equality problems within the mandate and legal competencies.
