With the intention of accurate interpretation of Article 72 of the Rules of the Procedure of the Assembly of Republic of Kosovo related to review procedure of independent institutions’ annual reports, the Ombudsperson has delivered today the Report with Recommendations to the President of the Assembly of Republic of Kosovo and the two respective Parliamentary Commissions.
Main feature of the Ombudsperson’s Reports is provision of information on situation of human rights in Republic of Kosovo as well as provision of concrete recommendations addressed to the responsible state institutions on improving the current situation, thus it is necessary to have a substantial review of findings in the field of human rights. This Ombudsperson’s role in provision of recommendations is attested in Constitution as well as the Law No. 05/L-019 on Ombudsperson.
The Report analyses and reasons supplementing of the Rules of the Procedure of the Assembly of Republic of Kosovo, specifically of Article 72 of this Rule of the Procedure, Article which determines specific procedures for independent bodies established by the Assembly, which means that the Ombudsperson’s Annual Report should not be subject of voting for adoption according to procedures of this provision, since OI is not an institution established by the Assembly, but has been anticipated directly in the Constitution as well as it has specific nature of work.
The Ombudsperson in his Report ascertains that in the function of full compliance with international and European standards on human rights the Assembly of Republic of Kosovo ought to play crucial role on supervision of the level of implementation of recommendations that the Ombudsperson addresses to the responsible institutions.
On the other hand, the Ombudsperson in his Report, recommends to the Assembly of the Republic of Kosovo to clarify specifically that particular procedures for the review of “annual report of an independent body, established by the Assembly”, defined in Article 72 of Rules of Procedure of the Assembly of the Republic of Kosovo, including voting on the approval of the report, are not applied to the Ombudsperson’s Annual Report. At the same time it is recommended to the Assembly to supplement the Rules of procedure of the Assembly of the Republic of Kosovo in order to define specific procedures for the review of Ombudsperson’s Annual Report, by including supervision of implementation of Ombudsperson’s recommendations by other State authorities.
