Increase of violence acts in schools ought to be very distressing for the state institutions which are responsible for ensuring respect of children’s rights, with the special emphases on physical integrity and their human dignity.
Violence remains unacceptable, intolerable and in contradiction with the legislation at effect for the Ombudsperson. Constitution of Republic of Kosovo determines that every child enjoys the right to be protected from violence, ill-treatment and exploration. The European Convention on Children’s Rights, requests protection of children from all forms of violence and determines states’ liabilities in undertaking adequate actions in this direction.
Law on Pre-University Education in Republic of Kosovo, bans corporal punishment or any other form of punishment in all educational and vocational institutions, either public or private, while the Regulation QRK - no. 21/20013 of the Protocol on Prevention and Referring of Violence in Pre-University Educational Institutions, determines roles and responsibilities of educational institutions as well as other institutions as per prevention and handling of violence cases towards children along with procedures for addressing of this issue. Furthermore, Criminal Code of Kosovo stipulates that in cases of abuse, upset or when children’s dignity is impaired by official persons, through misuse of position or authorization, one can be detained from 6 moths till 5 years.
In order to prevent increase of violence acts and corporal as well as psychological mistreatment among children, but also the violence exercised by teachers towards children and violence cases caused by children or their family members towards teachers, further actions and attempts are needed by all state institutions as well as inclusive approach in order to properly and timely address this phenomenon.
Use of force, in all its forms, causes detrimental and often unrepairable physical and psychological consequences. The Ombudsperson requires attentiveness and mobilization of responsible state institutions, organizations of civil society, parent councils, teachers, health experts, pupils and others in respect and appropriate implementation of legislation as well as drafting of respective school curriculum for prevention and addressing of violence at schools. It is more than necessary unstreaking of all mandatory actions so that children, but others as well, are offered appropriate safety, protection and adequate assistance anywhere, with specific emphases within school premises.
The Ombudsperson expects from media, respectively from journalist that while reporting about the violence cases at schools, but also in all cases when children are principal part of press reporting, have due regard and respect children’s rights, their privacy, their best interest not only as an individual but as group of individuals, directly influencing in this way in respect of children’s dignity and integrity and the rights guaranteed to them.
